- The American Association of Homes and Services
for the Aging (AAHSA), and the Florida
Association of Homes and Services for the Aging
(FAHSA) in conjunction with the Askew Institute
on Policy and Society at the University of
Florida, would like to invite you to attend an
important event on October 30 at the Doubletree
Hotel, 10100 International Drive, Orlando. This
statewide discussion has been organized to
promote a dialogue among members and policy
leaders about the future of long-term care and
how we, in Florida, are going to pay for it.
This interactive discussion has been designed
for all members and all member types - from CCRC
to HCBS. Now is the time to develop and share
ideas, hear from national and state policy
leaders, and voice your opinions about the
future of quality care for Florida's elders.
After the event, the Askew Institute will
prepare a synopsis of the presentations, member
discussions and recommendations.

Senate Interim Study Issues
Recommendations to the Legislature on Florida
ALF Licensure Structure -- During the
legislative interim, the Senate Health
Regulations Committee reviewed the current ALF
licensure structure in Florida. The purpose of
the review was to determine whether
modifications to Florida's licensing structure
might be appropriate at this time. The Senate
Interim Report includes input from stakeholders
(including FAHSA) and a review of ALF licensure
in other states.
There was also concern that the repeal during
the 2009 legislative session of a requirement
for a medical review team to assess whether a
resident is appropriately residing in an ALF
created uncertainty regarding the determination
of a resident's placement in an ALF. Senate
staff also reviewed the implications of this
repeal.
Senate staff recommends the following changes to
the Legislature:
- Repeal the LNS specialty license and
authorize a standard-licensed ALF to provide the
nursing services currently authorized under the
LNS license.
- Require an additional inspection fee of $296
plus $10 per resident based on the total
licensed capacity for initial and renewal
applications for an ALF standard license of a
facility that indicates that it intends to
provide LNS services.
- Require ALFs to periodically report
information electronically to AHCA, as
determined by rule, related to resident
population, characteristics, and attributes.
- Authorize the AHCA to determine the number
of additional inspections required for an ALF
that provides LNS based on the type of nursing
services provided and the number of residents
who received LNS as reported by the ALF.
- Repeal the requirement for the AHCA to
inspect all ECC licenses quarterly.

Executive Agencies Submit FY 2010-11
Budget Requests with Significant Budget Cuts
- Cutting the budget is the name of the game
again. Both the Agency for Health Care
Administration (AHCA) and the Department of
Elder Affairs (DOEA) are proposing significant
budget cuts for the coming fiscal year. This is
necessary to cope with the loss of federal
stimulus dollars, as the enhanced match ratio
drops back to its pre-ARRA level (American
Recovery and Reinvestment Act of 2009) on

Good News/Bad News: State Revenues
Exceed Estimates, But Unemployment Rate Reaches
Highest Level in Decades - Florida's
unemployment rate in September climbed to 11%,
the highest it has been in 34 years (October
1975). The September rate is 0.2 points higher
than the previous month (August 2009) and 4.3
points higher than one year ago (September
2008). The state has lost 360,000 jobs since
September 2008.
Consumer confidence is up and foreclosures are
down. At a recent meeting of the Florida
TaxWatch Council of Economic Advisors, there was
a consensus that a slow national recovery has
begun or will soon begin. To read more from the

FAHSA E-mail Server to be Replaced
- We would like to advise you that the FAHSA
e-mail server is due for a replacement. This
work will take place on the weekend of October
24 and 25. We anticipate that the work will not
cause any interruption in the delivery of e-mail
messages you send to FAHSA, but with computer
work you never know what can crop up...We ask
for your patience and understanding in case you
receive system messages that your e-mail has not
been delivered..If the matter is urgent, please

information.

Change the Final Rule -- On October 15,
2009, the Federal Register published proposed
amendments to the Final Rule on Income

AMDA Requests Comments on the Clinical
Practice Guidelines on Nutritional Status in LTC

from the American Medical Directors Association
(AMDA) for review and comment on the Clinical
Practice Guideline (CPG), Altered Nutritional

of the recession and health care reform may
