Screening Updates --
Since last week, 38 additional live scan sites have been added
to the
AHCA Vendor list or the Cogent active locations web page
this week. There are over 100 Live Scan locations posted and
many providers who are choosing to set up their own LiveScan
machines (in house). Many of the DMV sites are now active on the
Cogent website and more are expected to come online next week.
AHCA has received a large
number of screening results from LiveScan vendors submitted
since August 2, 2010, that do not contain a Social Security
Number for the person who was screened. Without the Social
Security Number they cannot post the screening results in the
AHCA Background Screening Results Website. Please be sure that
all future screening candidates provide their Social Security
Numbers at the time their prints are scanned.
If you have checked the
AHCA Background Screening Results Website
and are unable to find screening
results of a LiveScan screening submitted more than 7 days ago,
the Social Security Number may be missing. To correct, please
fax the Names, Dates of Birth and Social Security Numbers for
each missing screening result to: (850) 487-0470. Results will
be corrected and posted to the AHCA Background Screening Results
Website.
AHCA expects to implement an
improved phone system in the Background Screening section this
week which will assist with call volume and response. Any new
background screening resource documents will be posted on the
AHCA website.

HHS
Provides Florida with $1 Million to Regulate Health
Insurance -- U.S.
Health and Human Services (HHS) Secretary Kathleen Sebelius
announced this week that Florida insurance regulators will
receive $1 million from the federal government to better
help the state regulate health insurance premiums. According
to a summary of the grant application, $644,416 will be
spent on salaries and benefits for six employees, including
an economist, project coordinator, and actuary. Another
$270,000 will go to computer contractors to help build a
more consumer-friendly website.
The Florida Office of
Insurance Regulation will seek approval during the 2011
legislative session to review and approve large group health
insurance premiums and out-of-state policies. Florida does
not have review authority over either currently.
New
Federal Regulation Prohibits Employees Under 18 from
Operating Lifts --
The Department of Labor, Wage and Hour Division (WHD) has
declared that the operation of power-driven hoisting
apparatus is particularly hazardous for minors under the age
of 18. As a result of the designation, employees under the
age of 18 are prohibited from "operating, tending . . .
working from, repairing, servicing or disassembling an
elevator, crane, derrick, hoist or high-lift truck." The
WHD has confirmed that mechanical lifts used for lifting and
transferring the elderly fall within the prohibition.
Additionally, the regulation prohibits employees under the
age of 18 from tending the equipment which includes
assisting in the hoisting tasks being performed by the
equipment. Prior to July 19, 16 and 17-year-olds were
permitted to operate devices in this category if they
weighed one ton or less. The full text of the rule is

Premiums for Medicare
Prescription Drug Plans to Remain Low in 2011 --
The Centers for
Medicare & Medicaid Services (CMS) announced that average
2011 Medicare prescription drug plan premiums will remain
similar to rates beneficiaries are currently paying this
year. This, coupled with new discounts for brand-name drugs
through the Affordable Care Act, will help make medications
more affordable for Medicare beneficiaries in 2011 and
beyond.
The Effect of the Economy on the Nonprofit Sector --
A recent survey,
"The Effect of the Economy on the Nonprofit Sector",
conducted by Guidestar, measures the impact of economic
times on the nonprofit sector. Among respondents, nearly
half were CEOs, executive directors, or presidents in the
nonprofit industry. The results indicate:

Some 40 percent of participants reported that
contributions to their organizations dropped between
January 1 and May 31, 2010, compared to the same
period a year earlier.
-
Eight percent indicated that their organizations
were in imminent danger of closing.
-
Sixty-three percent reported a total increase in
demand for their organization's services between
January 1, 2010 and May 31, 2010, compared to the
same period a year prior.

Article on Home Health Agencies (HHAs) Providing Durable Medical
Equipment (DME) in Competitive Bidding Areas
-- The Centers for Medicare & Medicaid Services (CMS) has
released MLN Matters Article #MM7014 to alert Home Health
Agencies (HHAs) that edits will be in place, effective for
services on or after January 1, 2011, to prevent them from
billing competitively-bid DME items in competitive bidding areas
and consequently, preventing the inappropriate payment of
competitively-bid DME items to HHAs. For more details, please

Proposed
Fiscal Year 2011 Fair Market Rents --
The proposed Fiscal Year (FY)
2011 Fair Market Rents (FMRs) were published in the Federal
Register recently. A 30-day comment period has been provided to
ensure that final FMRs are published by October 1. Subject to
public comment, the proposed FMRs are used in the Housing Choice
Voucher, the Moderate Rehabilitation, the project-based voucher,
and other programs that require location-specific economic data.

Florida Court
Hears Challenges to Constitutional Amendments
-- Three amendments, Amendment 3, dealing with property taxes;
Amendment 7, related to congressional and legislative
redistricting; and Amendment 9, designed to give voters an
opportunity to weigh in on President Obama's health care
overhaul, were all removed from the ballot because the summaries
of two and the text of the third were ruled misleading and
unclear. Justices heard appeals on behalf of Amendment 3 and
Amendment 7 and are expected to rule before September 2 when the
ballot goes to the printers.
New Report
Provides History and Perspectives on the CLASS Act
-- The new issue of the journal
Public Policy & Aging Report
focuses on the CLASS Act. The
edition's title is, "Bringing CLASS to Long-Term Care through
the Affordable Care Act" and it includes articles from AAHSA's
staff Barbara Manard, Vice-President of Long-Term Health
Strategies, and from AAHSA board member Kathryn Roberts, CEO of
Ecumen. The project was underwritten by the SCAN Foundation, a
relatively new foundation that is doing great work bringing
long-term services and supports to the forefront of policy
discussions.
These two articles, along with
others in the journal, combine to document the history of the
CLASS Act and offer perspectives on what the future might hold
when CLASS is implemented. It is a must-read for all of us who
care about making it affordable to care.

Responds to Question on Refrigerators in a NH Resident's
Room -- AHCA recently
responded to a FAHSA member's question on whether residents
can keep personal refrigerators in their rooms. The answer
was "yes" and the nursing home can establish the conditions
