Update on Enhanced Background Screening Implementation -- The implementation date for HB 7069, is August 1.  This is the bill that requires entities regulated by AHCA to ensure that all current employees and contractors have a Level 2 criminal background screening by July 1, 2015 and to ensure that all new hires and contractors after August 1, 2010 have a Level 2 screen and are cleared to work if screening is required by law. Please read the technical assistance brief dated June 17, 2010 that is posted on all FAHSA Member Alert Pages for further details on who must be screened.

Some of you have asked if AHCA has entered into a contract with a vendor that offers the electronic fingerprinting and Level 2 screening (FDLE and FBI) required by the bill.  According to AHCA sources, a decision is near at hand and should be announced within a week or two.  We have been assured that the vendor under consideration will be accessible in all areas of the state for a reasonable price. 

 
HB 7069 does not give providers the authority to require a Level 2 screening for prospective employees or contractors that must be screened at the higher level beginning on August 1.  If you submit a request for a Level 2 screening before that time for a prospective employee who is not required to be screened at that level under current law, there is a chance it won't be processed.

Florida State Surgeon General 2010 - 2011 Health Innovation, Prevention, and Management Awards -- Florida State Surgeon General Ana M. Viamonte Ros, M.D., M.P.H has announced the opening of the nomination period for the Florida State Surgeon General 2010 - 2011 Health Innovation, Prevention, and Management Awards.
 
Organizations, businesses, or programs that have received federal or state funding are eligible to apply, as long as the full responsibility and development is not that of the federal or state funding sources. Also, the organization, business, or program must be in operation for at least two years and address at least one of the following risk factors:
  • Nutrition
  • Obesity
  • Physical Activity
  • Access to Healthcare
  • Chronic Disease

Your Ideas and Suggestions are Needed -- Each year, FAHSA focuses on new and innovative themes, topics and presenters for the Annual Affordable Housing and Service Coordinator Workshops in Jacksonville. This year is no different and we have heard from several members who would like even more break-out sessions and topics. We are excited about this opportunity and want to make sure to cover as many "hot" topics and regulatory issues during the two-day event as possible.

Please take a few minutes to TAKE THE SHORT SURVEY by Tuesday, July 13, so we can begin planning for the workshop, scheduled on September 21 and 22, 2010, at the Hyatt in Jacksonville.
 
Legislative News

Governor Crist Calls for July Special Session -- This afternoon, Governor Charlie Crist issued a proclamation announcing a special session for July 20-23 at which time he will ask legislators to consider a constitutional ban on offshore oil drilling.  For the proposed amendment to be placed on the November general election ballot, it must be passed by August 4.  Senator Alex Villalobos (R-Miami) will sponsor the proposed amendment in the Senate.  No House sponsor was announced. 

Select Committee on Florida's Economy to Evaluate Economic Impact of Oil Spill & Recommend Legislative Action  -- Senate President Jeff Atwater has directed the Select Committee on Florida's Economy, chaired by Don Gaetz, to evaluate the economic impact of the Deepwater Horizon Oil Spill and recommend legislative action to address the consequences of this tragedy.  Chairman Gaetz, in a letter sent this week to Select Committee members, emphasized the gravity of the situation and the effect that it is likely to have on the states economy, which was just beginning to show signs of improvement.  He noted that "The projections of [economic] recovery which rely upon a stable economy are now unreliable in the face of what could be billions of dollars in lost income for Floridians and lost revenue for the state. Anecdotal reports are already demonstrating profound damage to the economy.

 
Revenues from our robust tourism industry support critical state services and also provide the resources for school systems, public safety, and local governments. Data on the impact of the spill on state and local revenue collections for activity that occurred in May will begin to become available in early July for statewide data and in late July or early August for data on sales tax activity at the county level and by business type."
 
The mission of the Select Committee is "to develop legislative proposals to strengthen Florida's economy and then to advance those proposals through the legislative process . . . Legislative proposals may take the form of bills to be considered by a special session or regular session of the Legislature."  As noted in last week's newsletter, the projected deficit for FY 2011-12 is already at $6 billion without factoring in economic damage from the oil spill. Revenues for the current fiscal year could also be affected, which could indeed result in a special session that focuses on job creation for Gulf Coast residents and cuts in the current state budget.

CMS Notice to Medicare Beneficiaries Provides Information about Hospital Observation Days Versus Admission -- Last week, policy wonks from AAHSA state affiliates engaged in a lively email exchange about recent trends by hospitals to use "observation" rather than "admission" days for Medicare recipients. CMS has been saying that hospital admissions will be carefully looked at to assure that all admissions are correctly determined based on patients' medical needs.  The term "social admissions" is used for people who come into the emergency room who don't need hospital care, but there is no place for them to go. Hospitals have been admitting these patients until they can find an appropriate facility that will accept them.  These "social admissions" will be the focus of expanded CMS reviews, which could affect the Medicare SNF benefit.  If the claim is denied, then there is no three-day stay.  Read more of this article in this week's Nursing Home Alert, NH10-23 by clicking on the website link below.

Florida Presbyterian Homes Receives CARF Re-Accreditation -- Congratulations to Florida Presbyterian Homes for their reaccreditation for the next five years, with the new term expiring in May 2015. Programs receiving accreditation are their Continuing Care Retirement Community and the Person-Centered Long-Term Care. The Florida Presbyterian Homes team worked incredibly hard on the survey, but more importantly, the surveys recognized their Person-Centered Approach in every service they provide.
