Nursing Home
Staffing Requirements to Change on July 1, 2010
-- This is a
reminder of the staffing ratio changes that will
occur on July 1, 2010. Under the current
regulations, nursing homes must maintain 1.0
nursing hours and 2.9 certified nursing
assistant hours per resident per day.
As a consequence
of the budget process, nursing homes will have
somewhat more flexibility in their direct care
staffing requirement starting on July 1. The
new provisions require 1.0 hours per resident
per day for nurses and 2.7 hours per resident
per day for certified nursing assistants, with a
weekly combined nurse and CNA average of 3.9
hours per day.
The practical
implication of this change is a little more
flexibility in scheduling of direct care staff.
Please consider the example of a nursing home
that routinely maintains 1.3 nursing hours per
resident per day. Prior to July 1, 2010 that
nursing home had to maintain a daily CNA
staffing ratio of 2.9 hours per resident per
day. However, after July 1 that same nursing
home will be able to reduce the CNA staffing (if
its residents' conditions allow this change) to
2.7 hours per resident per day and use .2 hours
of excess nurse staffing to achieve the required
3.9 combined staffing ratio. For more

AHCA Announces New
Assisted Living Unit Manager --
Last week, AHCA
Deputy Secretary Liz Dudek announced the appointment
of Shaddrick (Shad) Haston to the position of
Assisted Living Unit Manager within the Bureau of
Long-Term Care. Shad's contact information is as

replacing Bernard Hudson who replaced Alberta
Granger in 2009. Bernard will continue as the
manager of the Long-Term Care Unit which handles
nursing home licensure and other long-term care

Bernard.Hudson@ahca.myflorida.com.
Shad was a member
of the United States Navy from July 1997 through
July 2002. During this time he served at various
duty stations and finally in Operation Enduring
Freedom aboard the USS John F. Kennedy. He received
his Bachelors of Health Science from Campbell
University; and after graduation from Campbell, he
attended Southern University Law Center in Baton
Rouge, Louisiana where he received his J.D. Welcome
Shad.
ALF Faces $10,000 Fine for Death Related to
Ingesting Dishwasher Detergent --
A 93-year-old
South Florida assisted-living facility resident in
the late stages of Alzheimer's disease died recently
after swallowing dishwasher detergent. The ALF is
owned by a reputable national company. According to
a spokesperson for the company, which is fighting
the fine and citation, "The device with the dish
detergent in it was in a cabinet under the sink and
was attached to the dishwasher. The lines of the
device ran directly to the dishwasher. It took much
maneuvering and manipulation to get to the fluid,
including disconnecting the hoses."
Reportedly, AHCA
inspectors had warned the care center during a 2008
survey that it needed to secure the kitchen, beauty
salon and laundry room in its memory impaired unit
to prevent residents from having unsupervised
access. AHCA records indicated that the corrections
were made. Nonetheless, this resident made his way
into the kitchen and did what no one could have
anticipated. When an incident like this occurs,
surveyors are often more vigilant in checking for
similar problems in other facilities. Please be sure
that your risk management team reviews your
policies, procedures and practices for protecting
residents with dementia from products and equipment
that could be potentially harmful.
Be Sure to Update ESS Info for AHCA --
This week, nursing
homes and ALFs received a notice from AHCA asking
them to update their status in ESS and to record
their Census and Available Bed Information by 12pm
Friday, June 25, 2010, to assist with emergency
preparedness activities. Please access
ESS at this time to update current status
information. In addition, the Agency has
recommended these preparation steps:

Test emergency generators to confirm they
are working properly.
-
Check for access to a sufficient supply of
drinking water, non-perishable foods,
batteries, fuel, oxygen and other supplies
to provide quality care during a crisis.

Review emergency management plan with
current staff members.

Background

Florida's
Population Continues to Decline --
Once among the fastest growing states,
Florida is now experiencing a population
decline. According to an article that
appeared in the Sarasota Herald Tribune this
week, the biggest losses between 2008 and
2009 occurred in Cape Coral, St. Petersburg,
Deltona, Fort Walton Beach, Sunrise, North
Port, Bradenton, Sarasota, Venice, and Punta
Gorda. The article pointed out that
according to the latest census population
estimates "no Florida City with more than
100,000 people ranked in the country's top
75 for growth last year." For a state that
depends on population growth for revenue,
the news is not good. Economists speculate
that the recession and high employment rate
are reasons for the shift. Retirees in
particular are staying put because of the
housing market. This has affected not only
migration of retirees to Florida but also
retirees living in Florida who are
considering downsizing or moving to a
retirement community.
Tamiflu:
Counterfeit Product Sold on Internet
-- FDA notified consumers and healthcare
professionals about a potentially harmful
product represented as "Generic Tamiflu"
sold over the Internet. FDA tests revealed
that the fraudulent product does not contain
Tamiflu's active ingredient, oseltamivir,
but cloxacillin, an ingredient in the same
class of antibiotics as penicillin. Patients
who are allergic to penicillin products are
at risk of experiencing similar reactions
from cloxacillin. This includes a sudden,
potentially life-threatening reaction called
anaphylaxis, with symptoms that include
difficulty breathing, chest tightness,
swelling of the throat or tongue, hives,
dizziness, loss of consciousness, or a rapid
or weak pulse.
The FDA advises anyone possessing or
encountering any of these fraudulent Tamiflu
drugs not to use them and to contact the
FDA's Office of Criminal Investigations by
visiting the
OCI website.

HH PPS PC Pricer Updated
-- The CY 2010 Home Health Prospective Payment
System (HH PPS) PC Pricer has been updated with
revised logic required by the Health Care Reform
legislation. The PC Pricers are available on their
web page under
the Downloads section. If you use the CY 2010 HHA
PPS PC Pricer, go to the page above and download the
latest versions of the PC Pricers with the revised
logic. There are now two CY 2010 PC Pricers. One is
for claims 10/01/2009 to 03/31/2010 and another is
for claims 04/01/2010 to 09/30/2010. Both were
updated on 6/17/2010.
Enhancements to Home Health Consolidated Billing
Enforcement
-- Medicare instructions regarding delivery of
Non-routine supplies intended for use over an
extended period of time have been changed. Now
suppliers are instructed to report the delivery date
as the 'from' date and the date by which the
supplies will be used in the 'to' date. When this
causes the 'to' date on a supply line item subject
to consolidated billing to overlap a HH episode, the
service is rejected contrary to the original intent
of this edit. Effective October 1, 2010, CMS is
implementing new requirements to modify this edit in
order to restore the original intent to pay for
supplies delivered before the HH episode began.

HUD Launches $100 Million Grant Program
-- During a keynote address to The Atlantic's
inaugural Future of the City Forum in Washington,
D.C., U.S. Housing and Urban Development (HUD)
Secretary Shaun Donovan announced that HUD is
launching a $100 million Sustainable Communities
Regional Planning Grant program, the first of its
kind designed to create stronger, more sustainable
communities by connecting housing to jobs, fostering
local innovation and building a clean energy

-- AAHSA launches new social worker list serve. To

Mid-Term Election Approaching: Members
Encouraged to Host Legislative Events and
Candidates Forums --
With the
November 4th election around the corner,
FAHSA is
encouraging
members to hold candidate forums before or after
the primary election on August 24. If the
candidates for specific legislative seats of the
same party affiliation, the election will be
decided during the primary election, so the
event must be held before August 24. Otherwise,
you have more time to organize and plan the
event.
Last Friday
was the last day for qualifying to run for the
Florida House of Representatives or Senate. The
latest information on individuals who are
running for specific House and Senate seats can
be viewed at the
Florida Secretary of State website. If your
senator or representative does not have
opposition or is not up for reelection, please
consider holding a forum or meeting where he or
she has the opportunity to address your
residents and staff about the 2010 legislative
session and what is anticipated for the coming
year. Thus far, the following organizations
have committed to holding a legislative forum or
candidates event:

34 Automatically Elected To State Legislature --
Last Friday
was the deadline for qualifying as a candidate
for the legislature and statewide office.
Twenty-seven House and 7 Senate candidates were
elected automatically because they had no
opposition. The Senators elected without
opposition, include Sen. Don Gaetz, Senate
President elect Mike Haridopolos, Sen. Arthenia
Joyner, Sen. Joe Negron, Senate Democratic
Leader Nan Rich, and former House members David
Simmons and Maria Sachs. Individuals elected to
the House without opposition include: Matt

Interviewing Vulnerable Adults -- The
Video on Interviewing Vulnerable Elders (VIVE)
was funded by the Picker Institute and produced
by the UCLA/JH Borun Center. The content in this
video is the same that was presented at the CMS
April National Train the Trainer Conference and
will be helpful for training staff using
effective interviewing techniques. To order a

The Center for
Health Care at Alliance Unveils State-of-the-Art
Therapy Program -- Last Friday, The
Center for Health Care at the Alliance Community
for Retirement Living held an open house to
showcase exciting changes to its therapy
program. The open house was geared to medical
professionals and hospital discharge planners
who refer patients to the nursing home. Invited
guests had an opportunity to tour a redesigned
physical and occupational therapy room that now
accommodates recently purchased state-of-the-art
weight-bearing machines that will be used
primarily by short stay residents and residents
of independent living in need of rehabilitation.
The professional trainer who helped develop the
machines and a related strength training program
for seniors was on hand to explain the benefits.
He will be consulting with Alliance as they move
forward with this new initiative, which will
eventually be open to residents and staff as
part of a wellness program.
Each of the five new machines is designed to
focus on specific muscle groups. The low back
and leg press machines build strength for
walking, fall prevention and stability. A mid
row machine is designed to increase arm strength
and help retract shoulders for improved
breathing, posture and balance. A tricep press
machine builds arm and shoulder builds strength
for getting out of chairs and picking up and
carrying things. The abdominal press increases
core strength for stability, posture and
balance. According to the consultant who
co-author of a 1999 study of Strength Training
in Nursing Facilities, fewer than 1000 SNF in
the nation utilize this equipment. Even then, it
is not always used with regularity.
Alliance also converted a meeting room to a
kitchen, dining and sleeping area that will be
used by occupational therapists to help
residents regain essential skills before they
return to their home. This room was part of the
tour. Congratulations Alliance on this new
venture!
