Lawmakers End 2010 Legislative Session -- The Florida Legislature concluded the 2010 Session on Friday, April 30, shortly before 9 p.m. Lawmakers chose to forgo the customary sine die which signals the end of session and opted not to gather in the rotunda between the Senate and House chamber to celebrate their accomplishments with the Governor.  Instead, House members adjourned without waiting for the Senate to finish.  After the Senate concluded its business, House members moved to the Senate where they said their good-byes. By that time, Governor Crist had left the Capitol for a meeting in Miami. It was pretty obvious that the Governor was not part of the plan, after announcing his decision the previous evening to break from the Republican party.

The 2010 Legislature began on a fast track by passing a bill (HB 7033 by Economic Development & Community Affairs Policy Council, Rep. Dave Murzin and Rep. Jennifer Carroll) to delay a $1.8 billion increase in unemployment tax payments for Florida businesses. The bill passed and was signed into law by Governor Crist before the end of the first day of the 2010 Legislative Session.  In sharp contrast to that first day, the session ended with a fractured political environment and the possibility of the Governor vetoing all or part of the $70.4 billion budget bill. 
 
Faced with a $3.2 billion deficit, lawmakers not only managed to pass a balanced budget, they increased spending by approximately $4 billion for FY 2010-11 without increasing taxes or fees. The budget includes $2.3 billion in federal stimulus money that starts to dry up next year. It counts on $430 million in Seminole gambling money that has been accruing while Governor Crist and lawmakers hammered out a deal to give tribes exclusive rights to high-stakes card games and slots. 

Even though many House leaders insisted that they would not bank on $1 billion in expected Medicaid stimulus money from the federal government, the final budget includes $270 million in hoped for dollars. The rest of the deficit was plugged with money raided from trust funds and cuts in health and human services programs.

There's still a lot up in the air as Gov. Crist's veto pen and rumors of a special session to deal with public corruption loom.
Crist has line-item say over the budget and also has indicated his concerns about property insurance and abortion legislation that will come across his desk. In addition, he is disappointed that Florida's lawmakers failed to pass anti-corruption measures, which were among his top priorities.  If Crist does call lawmakers back to Tallahassee, he may ask them to revisit the state budget, particularly public school funding or he may reconvene to consider a constitutional amendment that would ban drilling off of Florida's beaches.

FAHSA's 2010 End of Session Wrap-up Regional Meeting Conference Call will be held on Tuesday, May 11, 2010, at 2:00 p.m. (EST).  FAHSA's public policy team will review the major issues and priority bills and will discuss Florida's big challenges for 2011.

Safeguard for Seniors Act -- Every day, hundreds of Floridians fall victim to financial fraud. Many of these victims are trusting seniors who were misled into making risky or inappropriate financial investments by unscrupulous agents and scam artists, including annuities and reverse mortgages.
 
To date, the program has helped Florida seniors recover nearly $11.2 million, and helped put some senior scammers behind bars. Plan to attend one of the upcoming workshops at locations listed below:

Leadership Academy Program Rescheduled for July 26-27 -- FAHSA plans to conduct the 2nd class of the Leadership Academy beginning on July 26 and 27, 2010, in conjunction with FAHSA's 47th Annual Convention and Exposition in Boca Raton.  Applicants who previously applied do not need to re-apply.  Scholarship funds to cover half of the tuition are available for those who would like to participate.  This training is a valuable resource to develop leadership skills.

State of Emergency Declared Due to Oil Spill -- The Governor has signed Executive Order 10-99 declaring a state of emergency due to the Deepwater Horizon oil release and includes the following counties: Escambia, Santa Rosa, Okaloosa, Walton, Bay, and Gulf.  

Federal Government to Release $220 million in Healthcare IT Stimulus Grants -- As part of the stimulus funding, $220 million in grants for pilot programs will be disbursed to test healthcare information technology systems. The money will be spread among 15 different communities across the country.  The grants are expected to create roughly 1,100 jobs paying an average of $70,000 per year, according to a report from Bloomberg News.

Employer Tax Benefits Available -- Under the Hiring Incentives to Restore Employment (HIRE) Act, enacted March 18, 2010, two new tax benefits are available to employers who hire certain previously unemployed workers ("qualified employees").  Please read more by clicking on the General Alert news link below.
 
AAHSA Hosting Series of Health Reform Town Hall Updates -- In an effort to help members understand the new health reform law, AAHSA is hosting a series of town-hall style conference calls. Registration for the call on May 13 at 2 p.m. Eastern is still open. The call will cover payment changes, the CLASS Act, demonstration programs and what the legislation's emphasis on HCBS could mean for providers, and provisions affecting employers in 2010 and 2011. Space is limited, so register now.
 
Wellness Benchmarks Issued -- The International Council on Active Aging and the ProMatura Group announce the release of the ICAA/ProMatura Wellness Benchmarks. For the first time, industry wide metrics will capture the contribution and value of wellness-lifestyle activities, fitness and recreation-to a retirement property's mission and bottom line.  For additional information on the benchmarks, look in the Management section of the ICAA website.

Medicare-Certified Home Health Agencies: HHCAHPS Requirements -- If you need additional information on how to start the implementation of the Consumer Assessment of Healthcare Providers and Systems (CAHPS®) Home Health Care Survey (HHCAHPS), the Home Health CAHPS website may help.
 
If you are a HHA with less than 60 HHCAHPS eligible patients annually, by June 16, 2010, you will need to submit the Exemption Form.  If you have 60 or more HHCAHPS eligible patients annually, then you will need to do a dry run in the third quarter 2010 (July, August, and/or September), and contract with an HHCAHPS survey vendor listed on the Home Health CAHPS website.

HCBS Funding Protected -- In a challenging budget year, legislators protected funding directed to home and community-based long-term care services for Florida's seniors, their families and other caregivers.  To review the final budget items, please click here to review a spreadsheet developed by the Department of Elder Affairs. 

Highlights include: 
  • $8.2 million to serve 4's and 5's on our ADA and ALE waiting lists (line 23)
  • Reduction to Home Care for the Elderly (HCE) was restored - fully funded with recurring dollars for 2010-2011
  • $6.8 million for Nursing Home Transition (line 7 on spreadsheet)
  • $2.6 million for 200 additional PACE slots that are named in proviso - 100 for Hillsborough County and 100 for Pinellas County (line 20 on spreadsheet)
  • Alzheimer's Projects are funded with non-recurring dollars, $5.8 million (means that this funding ends June 30, 2011 unless funded next year) This item includes Memory Disorder Clinics, the Brain Bank, and Alzheimer's Projects (lines 14 and 14a on spreadsheet)
  • Local Services Programs are funded with non-recurring dollars, $7 million (means that this funding ends June 30, 2011 unless funded next year)
  • Alzheimer's Waiver Sunset - all clients were transitioned to other waivers
  • No changes to Channeling or Adult Day Health Care Waivers as contemplated by the Senate
  • Additional CARES staff (18 assessors, 3 RNs, 1 Regional Supervisor) and 3 Diversion Contract Management staff (lines 15 and 16 on attached spreadsheet) 
  • $1.7 million for a senior center in Miami-Dade County (line 34 on spreadsheet)
  • $1.2 million for a senior center in Martin County (line 31 on spreadsheet)
  • $2.2 million in additional federal funding for various grants.
  • Conforming bill language to add additional unfunded PACE slots for SW Miami and Polk, Highlands, and Hardee counties
HUD Creates Open Government Plan -- HUD has identified ways to utilize the principles of transparency, engagement, and collaboration to increase mission efficiency and efficacy by creating a comprehensive plan that takes into account the specific culture, policy, and technology issues that need to be addressed in order to leverage open government to serve HUD missions. 

Through open government, HUD seeks to increase transparency, encourage engagement and drive collaboration. Some of the steps to achieve these goals include improving access to and the timeliness of HUD's financial and mission-related information by proactively making data available online in consistent, open formats, while protecting privacy, security, and confidentiality. Also, creating public online forums to solicit feedback from HUD's customers and guide that feedback into actions that improve mission performance, and providing the public with the online ability to review and provide feedback on proposed rule changes before they are implemented.  To read a copy of HUD's plan, click here

Providers to Need NPI for Medicare, Medicaid Enrollment and Reimbursement -- In an effort to crack down on health care fraud, the Centers for Medicare & Medicaid Services (CMS) this summer will require all providers and suppliers who qualify for a National Provider Identifier (NPI) to include that on all enrollment applications, as well as payment claims.
