Budget Continues to Dominate Legislative
Agenda -- The big news at the Capitol
this week continues to be the budget. The House
and the Senate have released their respective
budget recommendations for health and human
services. The House proposal is much more
favorable. To view a comparison, please read

On Monday, Senate President Jeff Atwater was
quoted in the press as saying that he could not
guarantee that funds expected from the six-month
Congressional extension of Federal Medicaid
Matching Percentage (FMAP) will be used to avoid
cuts in Health and Human Services programs. He
indicated that instead, the funds could be used
to repeal or lower fee increases adopted by the
2009 Legislature primarily for motor vehicle
fees and licenses as well as for a school sales
tax holiday. The House leadership has hinted
that the money may go into state reserves. If
FMAP funds are extended through FY 2010-11, they
would go a long way in offsetting cuts in health
and human service programs if the Legislature
used them for that purpose.
A number of FAHSA priority bills were acted on
in committee this week, including bills related
to continuing care contracts, mandatory
defibrillators in assisted living facilities,
elevator regulator relief for multi-family
residences, and preservation of affordable
housing. FAHSA was successful in amending SB
1172 to extend the provisions in it related to
elevator regulation to apartments, including
those in continuing care and other similar
retirement communities. We are working to do
the same in the House. For a summary of action

Workshop on March 23-24 -- Join us for
FAHSA's annual Legislative Workshop, March 23-24
in Tallahassee. FAHSA has discounted the
registration fee this year to offset the cost of
a flight. In addition, a substantial discounted
rate was added for the second and subsequent
participants from your community to attend the
workshop in Tallahassee and learn about the
legislative process, visit legislators, and meet
other FAHSA members. Online registration is now

Nominate Your Colleagues for a FAHSA
Award -- As an aging-services
professional, you are attuned to who your
organization's exceptional leaders and
innovators are. Recognize them by nominating

The FAHSA awards honor organizations and

Scholarships Available for FAHSA's
Leadership Academy -- Scholarship funds
to cover half of the tuition are available for
those who would like to participate in the next
Leadership Academy program. FAHSA, in
partnership with the University of Florida
Leadership Development Institute, has developed
a leadership certificate course for
professionals working in long-term care,
affordable housing or home and community-based
services. This training is a valuable resource
and will help you develop your leadership style
and capabilities.
During the three-month course (both onsite and

The New MDS 3.0 Resident Assessment
Instrument (RAI) Course: A Strategic and
Systematic Approach -- Please plan to
attend the MDS 3.0 intensive two-day training
program scheduled on May 4-5. This workshop is
targeted for staff familiar with the MDS 2.0 RAI
process, and for participants who would like to
become familiar with the changes to the RAI
process with MDS 3.0.
The new MDS 3.0 is four times the size as the
current assessment tool. Although the process
is similar, there are major differences. Jean
M. Bean, RN, Director of Clinical Services,
Covenant Retirement Communities will be
attending the MDS National Train the Trainer
Conference in Baltimore on April 13-15, and will
then be FAHSA's presenter for this training.
She will provide participants with the latest
information, straight from CMS. Next week, a
copy of the brochure and online registration
will be available on the FAHSA web site.

Fire Marshall Adopts
New Requirement for Commercial Buildings --
The Aldridge-Benge Firefighter Safety Act
unanimously passed the Florida House and Senate
during the 2008 Legislative Session. The final rules
were published in the Florida Administrative Weekly
(FAW) recently, and all buildings should be in
compliance no later than March 13, 2010 for
enforcement. The statute requires the owner of any
commercial, industrial or multi-unit residential
structure of three units or more to install an
identification symbol adopted by rules of the State
Fire Marshal to be placed near the main entry of the
structure. The signage should be fastened to the
buildings with roof or floor trusses if the building
is constructed of light frame trusses. Read the

Census and Long-Term Care Facilities
-- AAHSA has received reports from members regarding
problems with the 2010 Census that is currently
being conducted by the U.S. Census Bureau. Because
there is a great deal of confusion about the role of
the facility in the process, Jennifer L. Hilliard,
M.M.H., J.D., Public Policy Attorney, AAHSA,
contacted the Census Bureau for clarification. Read

Preservation - Topic of Presentation and New
Federal Legislation --Yesterday, Janegale
Boyd, FAHSA's President/CEO, spoke to a group of
members from the Florida Alliance for Retired
Americans at the Capitol in Tallahassee. In
addition, the House Ways and Means Committee
released an update draft of comprehensive
preservation legislation. Please read Janegale's

Federal Legislation Update (From AAHSA)
-- The Senate passed a tax and unemployment
compensation bill that includes three provisions
that address our advocacy priorities. The
measure would extend increased federal Medicaid
funding through June 30, 2011. The increased
federal Medicaid match, originally scheduled to
end Dec. 31, would help to prevent any more
draconian Medicaid cuts next year. The bill
would extend the Medicare therapy caps
exceptions process through Dec. 31. It also
would prevent a 21 percent cut in the 2010
update for the physician fee schedule to which
nursing homes' Part B therapy rates are tied.
The differences between the Senate bill and the
measure originally passed by the House still
must be resolved, but we are optimistic that the
congressional leadership will expedite this
process. Thanks to all of you who communicated
