EHDOC/FAHSA Advocate for Restoring Section
202 Capital Grant Funding During HUD Meeting
Tomorrow -- Steve Protulis, CEO, Elderly
Housing Development & Operations Corporation (EHDOC);
Jason Pincus, Deputy Executive Director, EHDOC
and FAHSA's Housing Chair; and Janegale Boyd,
FAHSA's President/CEO will be meeting with HUD
Deputy Secretary Ron Sims to discuss restoring
the Section 202
Capital Advance Grant Program after the Miami
HUD Sustainable Communities Planning Grant
Meeting tomorrow. The Administration has
proposed eliminating funding for the Section 202
Capital Advance Program, which means no new
development. The
American Association of Homes and Services for
the Aging (AAHSA) is working on an advocacy
campaign to restore full funding for new Section
202 construction. FAHSA will be sending
additional information in the weeks to come.

CCRC Bill Officially Filed -- The CCRC
bill that FAHSA and FLiCRA worked on was
officially filed by Sen. Mike Fasano. The bill
number is SB 2030. An identical bill will be
filed later this week in the House by Rep. Bill
Proctor.

Continuing Care Retirement Community Salary &
Benefits Study --
Hospital & Healthcare Compensation Service (HCS) is
currently conducting its 13th annual
Continuing Care Retirement Community Salary &
Benefits study. The study is
conducted and published by
HCS in cooperation with the American
Association of Homes and Services for the Aging.
Questionnaires for the
compensation study are available on the
HCS website.
Hard copies of the questionnaires will be mailed
later this month. The
2010-2011 CCRC Salary & Benefits Report
will be published June, 2010.
There were 513 CCRC's
participating in last year's study, providing
compensation data on more than 73,674 employees
nationwide, covering 42 management and 40
non-management positions. Data again will cover
these positions and will be reported according to
revenue size, total unit size, geographic region,
principal city, and state. Twenty-two key fringe
benefits also will be covered, as will turnover
rates by department, and projected salary increases
for 2010 to 2011.
HCS also conducts and
publishes a separate
Nursing Home Salary & Benefits Report. Questionnaires
for that study will be mailed in March. The
2010-2011 Nursing Home Salary & Benefits Report
will be published in July, 2010. The annual
Assisted Living Salary & Benefits Report
was released earlier this year. |

Planning Grant Meeting Tomorrow --

Background Screening Bill On Fast Track in
House -- The House Criminal & Civil Justice
Policy Council voted unanimously in favor of a
proposed committee bill that makes major changes
to the background screening requirements for
licensed entities that are required by law to
screen employees and contractors. The bill
requires Level 2 screening of employees that
provide care to residents or have access to
resident funds or personal property. It also
requires screening of contractors that provide
care and services directly to residents. Mary
Ellen Early was among those who testified. She
asked committee members to consider an amendment
that would allow licensees to stagger
rescreening of employees that have not been
screened within the past five years. In
addition, she spoke about the fiscal impact on
providers and suggested that a Medicaid add-on
should be considered to cover a portion of the
cost for providers that serve Medicaid
recipients. Afterwards, Mary Ellen and other
interested parties met with Council staff to
discuss possible amendments to address concerns
about implementing and paying for the proposed
enhanced screening. The changes apply to
nursing homes, ALFs, home health agencies, adult
day programs, hospices, and most other AHCA-regulated
entities. Please participate in the 2010

Unemployment Compensation Fix Ready For Floor
Vote -- HB 7033 passed out the House Finance
& Tax Council this week and is now ready for a
floor vote in the House. The bill would provide
relief to businesses that were hit with huge
increases in Unemployment Compensation Tax this
year. It will probably be among the first bills
to pass the House.
Bill Filed on Medicaid Fraud
-- Legislation filed this week by Sen.
Charlie Justice (D-St. Petersburg) would allow
the Department of Health to expand the list of
health care providers whose licenses can be
suspended, revoked or denied if they're found to
be involved in Medicaid fraud. Lawmakers last
year passed legislation to revoke the licenses
of doctors, hospitals and pharmacists who are
found guilty of fraud, but the bill (SB 1958),
filed by Justice, would extend the requirement
to other professionals. The bill also would
require that the Office of Insurance Regulation
revoke a certificate of authority for health
insurers involved in Medicaid fraud. The
just-filed bill hasn't received any committee
assignments yet.
NEW Projections Show $1.34 Billion Medicaid
Deficit -- State economists now project
that state/federal spending for
Florida's Medicaid program will be $18.8 billion
or $1.34 billion higher than what lawmakers
budgeted last year. This translates into a $450
million deficit in state general revenue funding
that will have to be made up from state
reserves. The estimates, which were released on
Monday, also indicate that Medicaid is expected
to grow to $19.1 billion, or about two
percent, for the 2010-11 fiscal year. The news
does not bode well for budget makers or
providers and consumers who depend on Medicaid
for health care.

Report Questions Medicaid Waiver Program
-- A report released by the Office of Program
Policy Analysis and Government
Accountability concluded that the Alzheimer's
Disease waiver program in Broward, Miami-Dade,
Palm Beach, and Pinellas counties isn't as cost
effective as some of the other waiver programs
the state offers. According to the report, the
five year old program that provides
beneficiaries 11 different Alzheimer's Disease
services does not delay nursing home entry any
more effectively than other programs, and costs
between 10 to 28 percent more than what the
state pays for three other waiver program aimed
at keeping people out of nursing homes.

Database of Caregivers to be Available March
1 --
After 22 years of delays, a federal
database of potentially dangerous caregivers
will be made available to healthcare providers
on March 1. But a news report finds that
thousands of disciplinary records are missing
from it.
The federal database is
designed to compile information from various
state agencies to prevent dangerous or
incompetent caregivers from getting new
healthcare jobs in different states. But when
investigative journalists compared the federal
list to information on state Web sites, they
discovered discrepancies.
Healthcare workers can be
licensed in multiple states, making
comprehensive background checks difficult. Many
state licensing agencies have complicated rules
for sanctioning workers, and are often reluctant
to share information. In response to the
discovery of the discrepancies, Secretary of
Health and Human Services Kathleen Sebelius on
Friday sent a letter to the nation's governors
seeking assistance to fill the information gap.

New Waived Tests Under CLIA --

approved by the Food and Drug Administration as
waived by the CMS under the Clinical Laboratory
Improvement Amendments of 1988 (CLIA). The
newly-added waived tests have an implementation
date of 4/5/10 and are listed in the table in
the Background section of the article.
